Terms of Service

Welcome to Vysti. These Terms of Service ("Terms") govern your access to and use of the Vysti platform, including our website, applications, and related services (collectively, the "Service"), operated by Vysti Research ("Vysti," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is designed for students, teachers, and parents in educational settings. Age requirements vary by how you access the Service:

• Users 18 and older may create accounts independently.
• Users aged 13–17 may create accounts with the consent of a parent or legal guardian. By creating an account, you represent that your parent or guardian has reviewed and agreed to these Terms.
• Users under 13 may not create accounts on their own. Accounts for children under 13 must be created by a parent, legal guardian, or an authorized teacher or school administrator. See Section 2 below.

You must provide your accurate date of birth during registration. Providing a false date of birth is a violation of these Terms and may result in account termination.

2. Children and Student Accounts

Vysti is committed to complying with the Children's Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA), and other applicable child privacy laws.

Accounts for children under 13 may be created through the following paths:

• Parent or guardian enrollment. A parent or legal guardian may create an account on behalf of their child. By doing so, the parent or guardian consents to the collection and use of the child's information as described in our Privacy Policy.
• Teacher or school enrollment. A teacher or school administrator may enroll students under 13 in a class on the Service. By doing so, the teacher or school represents that they have obtained all required parental or institutional consent as required by applicable law, and that the Service will be used solely for educational purposes.

If we learn that a child under 13 has created an account without verifiable parental or school consent, we will suspend the account and delete the associated personal information promptly.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. Vysti reserves the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

Vysti provides AI-assisted writing analysis and feedback tools for educational use. The Service includes:

• Mark — Batch essay marking and class progress tracking for teachers.
• Revise — Writing feedback and guided revision practice for students.

The Service is intended as an educational aid and does not replace professional instruction, academic judgment, or official grading. Feedback provided by Vysti is generated by automated analysis and may not be comprehensive or error-free.

5. Subscriptions and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscriptions renew automatically unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings. Refunds are provided in accordance with applicable law.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Submit content that is defamatory, obscene, or infringes on the rights of others.
• Attempt to reverse-engineer, decompile, or extract the underlying algorithms or models of the Service.
• Use automated scripts, bots, or other means to access the Service beyond normal use.
• Resell, redistribute, or sublicense access to the Service without written permission.
• Interfere with the security, integrity, or performance of the Service.

7. Your Content

You retain ownership of all text, documents, and other materials you submit to the Service ("Your Content"). By using the Service, you grant Vysti a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service to you. We do not use Your Content to train machine learning models. We do not sell or share Your Content with third parties except as necessary to operate the Service.

8. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by Vysti Research and protected by intellectual property laws. Nothing in these Terms grants you any right to use Vysti's trademarks, logos, or branding without prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Vysti does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Vysti and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability. Vysti's total liability for any claim arising under these Terms shall not exceed the amount you paid to Vysti in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Vysti and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or your violation of these Terms.

13. Modifications

Vysti reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the effective date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

14. Termination

You may stop using the Service and close your account at any time. Vysti may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, without prior notice or liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Oregon, United States.
